Platform Terms of Service

1. Agreement to Terms

By creating an account on Curbivo ("the Platform"), you ("Vendor") agree to these Terms of Service. Curbivo is operated by 915 Web Design LLC ("we", "us", "our"). If you do not agree to these terms, do not use the Platform.

2. Platform Description

Curbivo provides online ordering, delivery management, loyalty rewards, and storefront hosting for mobile food vendors including food trucks, pop-ups, carts, and market stalls. We provide the technology — you provide the food and service.

3. Vendor Accounts

You are responsible for maintaining the security of your account credentials. You must provide accurate business information during registration. You are responsible for all activity that occurs under your account. You must be at least 18 years old and legally authorized to operate a food business in your jurisdiction.

4. Payment Processing

Curbivo uses Stripe Connect to process payments. By using our Platform, you agree to Stripe's Connected Account Agreement. When you connect your Stripe account, you authorize Curbivo to facilitate payments from your customers on your behalf.

5. Fees

Curbivo charges a service fee on each order processed through the Platform:

• Starter (Free): 1% service fee per order
• Growth ($29/mo): 0.75% service fee per order
• Pro ($79/mo): 0.5% service fee per order

Stripe's standard processing fees (currently 2.9% + 30¢) are separate and deducted by Stripe from each payment before it reaches your account. Curbivo's service fee is deducted as an application fee via Stripe Connect.

Subscription fees are billed monthly. We reserve the right to change pricing with 30 days notice. Fee changes do not apply retroactively.

6. Vendor Responsibilities

As a Vendor on Curbivo, you agree to:

• Comply with all local health, safety, and food handling regulations
• Maintain accurate menu items, prices, and availability
• Fulfill orders in a timely manner
• Keep your business hours and location information up to date
• Handle customer complaints and refund requests professionally
• Not use the Platform for any illegal or unauthorized purpose

7. Content & Branding

You retain ownership of all content you upload (logos, images, menu descriptions). By uploading content, you grant Curbivo a non-exclusive license to display it on the Platform and in marketing materials. Free tier accounts display "Powered by Curbivo" branding which is removed on paid plans.

8. Data & Privacy

Customer data collected through your storefront (names, emails, phone numbers, order history) is shared between you and Curbivo. You agree to handle customer data in compliance with applicable privacy laws. See our Privacy Policy for details on how we handle data.

9. Termination

You may close your account at any time. We may suspend or terminate your account if you violate these terms, fail to fulfill orders consistently, or engage in fraudulent activity. Upon termination, your storefront will be deactivated. Pending payouts will be processed according to Stripe's policies.

10. Limitation of Liability

Curbivo provides the Platform "as is" without warranties of any kind. We are not liable for lost revenue, food quality issues, delivery problems, or any indirect damages arising from your use of the Platform. Our total liability is limited to the fees you've paid to Curbivo in the previous 12 months.

11. Changes to Terms

We may update these terms at any time. We will notify you of material changes via email or through the admin dashboard. Continued use of the Platform after changes constitutes acceptance of the updated terms.
